OCX Terms of Use

OCX is a SEA-native marketplace platform for trading, grading, and storing collectibles (e.g., Pokémon TCG, sports cards, gaming items). By creating an account or using our services, you agree to these Terms of Use ("Terms"), including mandatory arbitration and class-action waiver (Section 24).
1) Definitions
- Buyer / Seller: A user that purchases or lists items on OCX.
- Platform / Service: The OCX website, mobile applications, APIs, and all related services.
- Listing: A product offered for sale by a Seller, including images, description, price, and condition.
- Order: A binding purchase agreement formed when a Buyer's payment is confirmed.
- Escrow: A temporary hold of Buyer funds (via OCX's payment processor) until item verification and delivery are complete.
- OCX Verified (AI Pre-Grade): Our automated authenticity and condition assessment, using computer vision; final determinations remain OCX's or third-party grader's discretion.
- Vault: OCX's custodial storage service for collectibles.
- Wallet (Buyer/Seller): An internal ledger balance on the Platform for credits (Buyer) or proceeds (Seller) to be used for purchases or withdrawn.
2) Eligibility & Compliance
- You must be the age of majority in your jurisdiction (18+ in most countries, 21+ in Indonesia) to use OCX independently.
- You represent that you are not located in, or subject to, any country, entity, or individual under sanctions by the UN, US, EU, or Singapore.
- You agree to comply with all applicable laws, including anti-money laundering (AML), know-your-customer (KYC), consumer protection, and tax laws in your jurisdiction.
3) Accounts, Identity Verification, and Security
- Accuracy: Keep your legal name, email, phone number, and address up to date.
- Verification: We may require ID documents, proof-of-address, selfies, or additional checks (including third-party services) to verify identity and prevent fraud.
- Security: You are responsible for safeguarding your password, 2FA codes, and account credentials. Report unauthorized access immediately.
- Risk controls: We may place limits on transaction volume, velocity, or certain features based on your account age, verification level, or transaction history.
4) OCX Wallets (Buyers & Sellers)
- Buyer's Wallet: Receives credits from refunds, cancelled orders, or deposits you add. May be used to purchase items.
- Seller's Wallet: Receives net proceeds (sale price minus fees) after successful delivery. You may request payout to your bank account subject to verification and any reserves (Section 13).
- Cash-out: You may request to withdraw your Seller's Wallet balance to a verified bank account or e-wallet. Minimum thresholds, processing times, and withdrawal fees may apply.
- Nature of funds: Wallets are ledger credits held by OCX, not bank deposits or stored-value instruments. Not FDIC- or deposit-insurance-protected.
- Set-off authorization: You authorize OCX to deduct from your Wallet balance any amounts owed (fees, refunds to buyers, chargebacks, penalties) before releasing payouts.
5) Listings and Catalog Standards (Sellers)
- Accuracy & completeness: Title, description, condition, year/set, language, grading (if any), and flaws must accurately reflect the item. Misleading listings may be removed or result in penalties.
- Media: Photos/videos must show the actual item (not stock images unless pre-approved), clearly depicting condition, edges, surface, centering.
- Price & availability: You must honor the listed price for any order that forms. Mark items unavailable if they are sold elsewhere or no longer in stock.
- Prohibited tactics: Duplicate listings of the same item, inflated or deceptive pricing, artificial scarcity, keyword stuffing, or manipulation of search/ranking.
- Edits & takedowns: OCX may edit or remove listings that violate policy, are low-quality, or conflict with catalog data.
6) Offers, Order Formation, and Cancellation
- Formation: A contract forms when payment is authorized and the order is confirmed. At that point, both parties are obligated to complete the transaction.
- Seller-initiated cancellation: Generally prohibited after order confirmation. If you cancel without valid cause (item lost/damaged, legal restriction), you may incur a penalty, and the Buyer receives a full refund plus potential compensation from the penalty.
- OCX right to cancel/reverse: We may cancel or reverse an order in case of payment failure, suspected fraud, listing violations, pricing errors, or force majeure.
- Pricing/description errors: OCX may cancel if an obvious error (e.g., $1 for a high-value card) is detected.
7) Verification, OCX Verified, and Third-party Grading
- Workflow: OCX employs AI pre-grading (computer vision on images) and may conduct physical inspection at our facility to check authenticity and condition.
- Outcome:
- Pass: Item is authentic and matches listing; released to Buyer or Vault.
- Fail (NAD/Counterfeit/Damage): Order canceled; item returned to Seller; Buyer refunded; Seller may face penalties.
- Limits: AI pre-grading is non-binding and supplementary. OCX does not guarantee market grade equivalence (PSA, BGS, CGC).
- Third-party grading (e.g., PSA/BGS/CGC): If you select professional grading, OCX coordinates shipment to the grading company. Additional fees apply. Final grade becomes official and binding for condition representation.
8) Prohibited and Restricted Items
You may not list, buy, sell, or facilitate transactions involving:
- Counterfeit, altered, stolen, or materially misrepresented items.
- Items banned by law/carriers; weapons, drugs, hazardous materials, live animals, human remains.
- Adult, violent, or illegal content; items infringing intellectual property without authorization.
Enforcement: OCX may remove listings, suspend accounts, withhold payouts, and report illegal activity to authorities.
9) Payments, Escrow, and Fees
- Methods: Cards, bank transfers, e-wallets (GoPay, OVO, Dana, etc.), or Wallet balance.
- Escrow by default: Buyer funds are held in escrow until item verification and delivery confirmation.
- Release events:
- Buyer confirms receipt and satisfaction (or auto-confirm after X days).
- Dispute resolved in Seller's favor.
- Fees (no tiers): OCX may charge transaction fees (percentage + fixed), payment processing fees, withdrawal fees, grading fees, Vault storage fees, insurance premiums. Fee schedules are published and updated periodically.
- Updates: Fees may be updated with 30 days' notice. Continued use = acceptance.
10) Shipping, Insurance, and Risk of Loss
- Seller → OCX (verification facility): Seller ships to OCX-designated address. Risk of loss transfers to OCX upon delivery scan. Seller responsible for packaging and declared value.
- Packaging: Follow Seller Guidelines (e.g., toploaders, bubble mailers, appropriate boxes). Damage from poor packaging may void insurance or lead to penalties.
- Insurance: Where OCX carries insurance or offers coverage (at cost), claims follow our Claims Policy; deductibles and limits apply.
- Unreceived/undeliverable: If item never arrives at OCX or Buyer, we investigate. Seller may need to file claim with carrier; Buyer receives refund if unresolved.
11) OCX Vault (Custody, Resale, Withdrawal)
- Role & ownership: OCX acts as custodian (bailee). You retain ownership. OCX does not acquire title unless you default on fees or abandon the item (Section below).
- Intake: Items entering Vault undergo verification. Once stored, they are cataloged and insured (per your insurance election).
- Storage & insurance: Storage fees (monthly or annual) and optional insurance premiums apply. You authorize OCX to debit your Wallet or charge your payment method.
- Resale from Vault: You can list Vault items for sale without physical withdrawal; OCX ships directly to the new Buyer, streamlining logistics.
- Withdrawal: Request shipment to yourself (fees + shipping apply). Processing time typically 3–7 business days. Item is removed from Vault inventory.
- Abandoned property: If fees remain unpaid for 90+ days and we cannot reach you, OCX may treat the item as abandoned, liquidate it to recover costs, and close your account.
12) Cancellations, Returns, Refunds, and Disputes
- Buyer remorse: Unless specifically stated in the listing (e.g., 7-day returns), there is no general right to return for change of mind. Exceptions: local consumer protection law may mandate cooling-off periods.
- Verification fail: OCX cancels the order; Buyer refunded in full; item returned to Seller (Seller pays return shipping if item was misrepresented).
- Not as described (NAD) / damage in transit:
- Buyer must file a dispute within X days of delivery and provide evidence (photos, videos).
- OCX investigates. If upheld, Buyer returns item; full refund issued; Seller liable for return shipping and may face penalty.
- If Seller contests, OCX may request the item be sent to us for re-inspection.
- Refund routing: To original payment method or Buyer Wallet (at Buyer's choice or by policy).
- Seller chargebacks: If a payment is later disputed or reversed (chargeback), Seller's Wallet may be debited; if negative, Seller owes OCX.
- Abuse: Repeated frivolous disputes may result in Buyer suspension.
13) Seller Payouts, Reserves, and Performance Health
- Payout timing: Displayed in your Seller Dashboard (typically 1–7 days post-delivery confirmation). May be longer for new sellers or high-value items.
- Reserves/holds: Factors include account age, dispute rate, listing accuracy, cancellation rate. OCX may hold a percentage of proceeds for 30–90 days as risk mitigation.
- Account health metrics: Late shipment rate, defect rate, cancellation rate, response time. Poor metrics → longer payout holds, listing restrictions, or suspension.
14) Platform Integrity & Acceptable Use
You agree not to:
- Circumvent OCX fees/escrow or engage in off-platform transactions for items discovered on OCX.
- Manipulate prices, demand, or reviews (shill bidding, wash trades, fake reviews).
- Interfere with security/integrity: scraping, reverse-engineering, introducing malware, DDoS, automated buying/selling bots (without written approval).
- Operate multiple accounts to bypass limits, reviews, or bans (unless explicitly permitted for business reasons).
Responses: Listing removal, account suspension, forfeiture of Wallet balance, legal action, reporting to law enforcement.
15) Taxes, Customs, and Regulatory
- Seller taxes: You are responsible for all sales tax, VAT, income tax, or other taxes on your sales. OCX may collect and remit certain taxes where legally required.
- Cross-border: Buyer is responsible for import duties, customs clearance, and compliance with destination-country laws.
- Invoices: You authorize OCX to generate invoices or receipts on your behalf for transactions, which may include tax details.
16) User Content & License to OCX
- Ownership: You retain rights to your photos, descriptions, reviews, or other content ("User Content").
- License to OCX: You grant OCX a worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your User Content for operating the Platform, marketing, AI training, catalog improvements, and related purposes.
- Restrictions: No unlawful, defamatory, obscene, or infringing content. No spam or misleading information.
17) AI, Data, and Model Usage
- OCX may use listing media, attributes, transaction data, and user feedback to train or improve AI/ML models (authentication, grading, pricing, recommendations). Data is aggregated and anonymized where feasible.
- Human-in-the-loop review applies for high-stakes decisions (authenticity, disputes).
18) Third-party Services
- Dependencies: Payments, grading, shipping, and insurance may rely on third parties. Their terms apply.
- Disclaimer: OCX is not responsible for third-party failures, delays, or breaches of their terms.
19) Beta Features & Service Changes
- Early Access/ Beta/preview: Features marked as such are provided as-is, may be unstable, and can be discontinued without notice.
- Service changes: We may modify, suspend, or discontinue any part of the Service with reasonable notice (except in emergencies or for legal/security reasons).
20) Warranties & Disclaimers
- The Service is provided "as is" and "as available." OCX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
- OCX does not warrant uninterrupted or error-free operation, or that items will meet your expectations. User-to-user transactions are between Buyer and Seller; OCX is a facilitator, not a party to the sale.
21) Limitation of Liability
- To the maximum extent permitted by law, OCX (and its affiliates, officers, employees, agents) is not liable for indirect, incidental, consequential, punitive, or special damages (lost profits, data loss, business interruption).
- OCX's aggregate liability for any claim is limited to the lesser of (a) fees you paid OCX in the 12 months preceding the claim, or (b) USD $100 / IDR equivalent.
- These limits do not restrict liability that cannot be excluded by law (fraud, gross negligence, personal injury).
22) Indemnity
You will indemnify and hold harmless OCX from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from (a) your breach of these Terms, (b) your User Content, (c) your violation of any law or third-party rights, (d) your sale or purchase transactions, or (e) any dispute between you and another user.
23) Suspensions and Termination
- We may suspend or terminate accounts for violations, suspected fraud, legal requirements, or inactivity. You will be notified and given an opportunity to cure (if feasible) unless immediate action is required.
- You may stop using the Service anytime. Outstanding obligations (fees, disputes, shipments) survive termination.
24) Governing Law & Dispute Resolution
- Governing law: [Indonesia / or the laws of Singapore, as finalized]. Exclude conflict-of-law principles.
- Arbitration: Disputes will be resolved by binding arbitration under [SIAC / BANI] rules, seated in [Singapore / Jakarta]. Exception: small claims court or injunctive relief for IP infringement.
- Consumer rights: Mandatory local consumer protection rights (cooling-off, warranty) cannot be waived and remain in force.
25) Notices & Contact
- We may contact you by email, in-app notification, or SMS. Ensure your contact details are current.
- Legal notices to OCX must be sent to the address below (email notices not binding unless we confirm receipt).

27) Changes to These Terms
- We may update these Terms prospectively with 30 days' notice (email or in-app banner). Material changes affecting fees or liability may require explicit acceptance. Continued use after notice = acceptance.
